TERMS OF SERVICE Effective Date: February 1, 2026
1. APPLICABILITY & DEFINITIONS These Terms of Service ("Terms") constitute a legally binding agreement between you ("User") and Oceanic Consulting VOF (trading as TOTEMVPN), a company registered in the Netherlands.
- "Service" refers to the VPN infrastructure, software, and website provided by TOTEMVPN.
- "Subscription" refers to the recurring paid access to the Service.
- "Account" refers to the user profile created to access the Service. By accessing, installing, or using our Services, you confirm that you have read and agreed to these Terms.
2. SERVICE DESCRIPTION TOTEMVPN provides Virtual Private Network (VPN) services, including encrypted data transmission and shared IP infrastructure, designed to enhance internet privacy. The Services are provided on an "as-is" and "as-available" basis. We do not guarantee uninterrupted service or specific speeds, as performance may be affected by network factors beyond our control (including ISP restrictions, local regulations, congestion, or third-party service policies).
3. FAIR USE & DEVICE LIMITS Your Subscription is subject to specific simultaneous connection limits (as detailed in your selected plan and/or Account dashboard). Circumventing these limits (e.g., via account sharing or technical workarounds) is prohibited and constitutes a material breach of these Terms. We reserve the right to implement reasonable technical measures to prevent abuse and ensure network stability.
4. ACCEPTABLE USE POLICY You agree NOT to use TOTEMVPN for:
- Any activity that violates Dutch, EU, or applicable international laws.
- Transmitting malware, viruses, or engaging in phishing/fraud.
- Attacking other computers or networks (e.g., port scanning, DDoS).
- Sending unsolicited bulk emails (spam).
- P2P/Torrenting: Permitted only on servers explicitly designated for P2P traffic.
5. SUSPENSION & TERMINATION We reserve the right to suspend or terminate your Account if you materially breach these Terms (including but not limited to violating the Acceptable Use Policy, exceeding device limits, or unauthorized account sharing). In such cases, refund eligibility will be assessed proportionally based on the nature of the violation and the remaining Subscription period, unless applicable law requires otherwise.
6. PAYMENTS & RENEWALS
- Direct Payments: Subscriptions purchased via our website are processed by Stripe. You authorize us to charge your payment method for recurring renewals unless canceled prior to the renewal date.
- App Stores: Subscriptions purchased via Apple App Store or Google Play are subject to the respective store’s billing, renewal, cancellation, and refund terms. We do not have access to manage, cancel, or refund these store-based transactions.
7. CHANGES TO TERMS We may update these Terms from time to time to reflect changes in law, security requirements, or our Services. If we make material changes, we will update the effective date and publish the updated Terms on our website (or notify you via email/app where appropriate). Continued use of the Service after the updated Terms become effective constitutes acceptance of the updated Terms.
8. LIMITATION OF LIABILITY To the maximum extent permitted by Dutch law, Oceanic Consulting VOF shall not be liable for indirect, incidental, special, or consequential damages. Nothing in these Terms excludes liability for willful misconduct, gross negligence, personal injury caused by negligence, or liability which cannot be excluded under applicable law.
9. GOVERNING LAW These Terms are governed by the laws of the Netherlands. Any disputes shall be submitted to the competent courts in the Netherlands, unless mandatory consumer protection law provides otherwise.
